Spousal Support/Alimony
Spousal support (sometimes referred to as alimony) determinations are based on: standard of living during the marriage, income of both parties, potential for future income, duration of the marriage, any career sacrifices made by a stay-at-home spouse, rehabilitative support needed to obtain an education and more. The judge makes a determination based on what is relevant and equitable. Determinations are subjective and require the advocacy of an experienced attorney who can aggressively protect your rights and financial interests. In fault-based divorce, the court will also consider abandonment, desertion, physical abuse and adultery.
Child support determinations
Child support determinations are based on a statutory formula that considers: income of both parties, standard of living of the child, special needs of the child, health insurance and day care expenses, median income of the community and more. It is important to work with an attorney who can ensure that these numbers are properly entered before a determination is made. You may be able to seek a modification of an original child support order if you or a dependant spouse has obtained a new job, has quit or been laid off or if either party remarries. In order to obtain a modification you must show a significant change in circumstances.
